چکیده | ||
The present study has attempted to answer the question: How is humanitarian law explained from the perspective of Islamic jurisprudence? Humanitarian law refers to a set of principles and rules designed to protect wounded, civilian, and vulnerable individuals during wars and conflicts. From the perspective of jurisprudence, the concept of humanitarian law is formed based on religious texts and Islamic teachings such as the Quran and the Prophetic tradition. Islamic humanitarian law is explained with a descriptive-analytical method based on Quranic and narrational principles, and cases of humanitarian law at different stages of war are discussed with a jurisprudential perspective. Islam emerged in the seventh century AD and carried the general title of commitment to "human rights," meaning non-violation of people's rights, which humanitarian law derives from this general law, but the official term humanitarian law was not formed until the mid-nineteenth century. The result obtained indicates that Islamic humanitarian law, while having dynamic and flexible moral principles that transcend time and space, is progressive and dynamic both theoretically and in practical discussions, and has a special deterrent and guarantee of implementation. | ||
