| Transferring a man's sperm in a woman's womb unnaturally is one of the emerging issues in the field of jurisprudence. The prevalence of "artificial insemination" especially for women unable to conceive naturally in today's world, on the one hand, the Islamic religion's emphasis on marriage and its importance, on the other hand, makes it important to clarify the jurisprudence of this issue. Although scattered researches have been done on the above issue; But due to its complex dimensions, independent research requires a coherent and comprehensive basis in order to get closer to the facts and free the seekers of Islamic knowledge from confusion. The current research, which is of a descriptive analytical type and its data was collected in a library method, has answered the questions that what is the jurisprudential and principled basis of artificial insemination? And in case of doubt, which basis should be referred to regarding the obligatory ruling of artificial insemination? The findings of the research show that although in general two bases of permissibility and caution have been proposed by the jurists, and each of them has opinions that rely on narrative evidence to establish their basis; However, it seems that the basis of caution is stronger considering the reasons such as the understanding of the Islamic tradition of adultery in this matter, the inclusion of the narrations about the prohibitions of marriage and marriage, and the reputation of the scholars as proof. | ||
